Terms of Use and End User License Agreement

These Terms of Use and End User License Agreement ("Terms") govern your use of Oarsum: Paddle Tracker ("Oarsum" or the "App"), provided by Oddsplash LLC ("Oddsplash," "we," "us," or "our"). By downloading, installing, accessing, subscribing to, or using Oarsum, you agree to these Terms. If you do not agree, do not use the App.

1. What Oarsum Is

Oarsum is a paddle-sport tracking, fitness, logging, and analysis app for activities such as kayaking, canoeing, stand-up paddleboarding, rowing, and similar water activities. Oarsum can help record paddles, display routes, calculate activity metrics, show local trip history, and provide optional subscription features.

Oarsum is not a safety device, rescue service, emergency communication system, marine navigation system, weather-warning system, medical device, or professional coaching service.

2. Important Water Safety Notice

Water sports involve inherent and unpredictable risks, including injury, drowning, hypothermia, collision, equipment failure, sudden weather changes, currents, tides, waves, poor visibility, fatigue, dehydration, wildlife, vessel traffic, and changing water access or legal restrictions.

You are solely responsible for deciding whether, when, where, and how to paddle. Before and during any paddle, you should use your own judgment, check current conditions from appropriate official and local sources, follow applicable laws and posted rules, wear appropriate safety equipment, and paddle within your ability.

You should wear a properly fitted personal flotation device or life jacket where appropriate or required by law. You should not rely on Oarsum as your only source of information for weather, route choice, water conditions, access, hazards, distance, location, health, fitness, or emergency decisions.

If you are in danger or need help, contact local emergency services or appropriate rescue authorities. Oarsum does not monitor your activity for emergencies and does not dispatch assistance.

3. No Navigation, Emergency, Weather, or Medical Use

Oarsum is not intended for navigational use and should not be relied upon as a primary marine navigation aid. Oarsum is not a chartplotter, marine safety system, rescue system, emergency communication tool, weather-warning system, medical device, or substitute for professional judgment.

Maps, routes, GPS tracks, water-body names, speed, distance, direction, weather context, safety notices, health metrics, and activity summaries may be inaccurate, delayed, incomplete, unavailable, or unsuitable for your circumstances. You must use official charts, local notices, weather forecasts, tide/current information, posted rules, safety equipment, and your own judgment.

4. GPS, Maps, Weather, Health, and Sensor Limitations

Oarsum may use GPS, motion sensors, Apple Health, Apple Watch, WeatherKit, MapKit, device sensors, and other Apple platform services. These systems can be inaccurate, delayed, incomplete, unavailable, or affected by device settings, battery state, signal loss, weather, terrain, water conditions, sensor error, Apple service availability, or other factors.

Routes, distance, speed, stroke detection, calories, heart rate, weather context, water-body names, launch or landing points, maps, and other metrics are estimates or informational aids only. They may be wrong. Do not use them as the sole basis for safety, medical, navigation, training, legal, access, or emergency decisions.

5. Assumption of Risk

You understand that paddling, boating, rowing, stand-up paddleboarding, kayaking, canoeing, and other outdoor water activities involve inherent and unpredictable risks, including injury, drowning, hypothermia, collision, equipment failure, sudden weather changes, currents, tides, waves, fatigue, dehydration, poor visibility, vessel traffic, wildlife, and changing access or legal restrictions.

You voluntarily assume all risks associated with your activities and your use of Oarsum. You are solely responsible for your route choices, equipment, physical condition, safety precautions, compliance with laws, and decisions before, during, and after any activity.

6. Eligibility and Responsibility

You must be legally able to agree to these Terms. If you are under the age of majority where you live, your parent or legal guardian must review and agree to these Terms and supervise your use of the App as appropriate.

You are responsible for your own conduct, equipment, route choices, physical condition, permissions, and compliance with laws and regulations.

7. License to Use the App

Subject to these Terms and Apple's App Store rules, we grant you a limited, non-exclusive, non-transferable, revocable license to use Oarsum on Apple-branded devices that you own or control, as permitted by Apple's Media Services Terms and applicable App Store usage rules.

You may not copy, modify, reverse engineer, decompile, disassemble, attempt to derive source code from, sell, rent, lease, sublicense, distribute, or misuse the App, except where applicable law expressly allows or where permitted by licenses governing open-source components included with the App.

8. No Oarsum Account

Oarsum does not use Oarsum accounts, registration, or sign-in of any kind. Core paddle tracking and Oarsum+ subscription features work entirely without creating an account, and there is no account to sign in to.

You are responsible for maintaining access to your Apple Account and any device security used with Oarsum, since purchases and device access are governed by Apple, not Oarsum.

9. Subscriptions and In-App Purchases

Oarsum may offer optional auto-renewable subscriptions, including Oarsum+ Seasonal Pass and Oarsum+ Annual Pass. Subscription benefits may include unlimited Deep Detail and Deeper Insight, advanced statistics, records, trends, patterns, efficiency analysis, stroke analysis, unlimited GPX exports, and other premium features described in the App or App Store listing. Paddle Intelligence is available without a subscription.

Subscriptions are billed through Apple. Your Apple Account will be charged at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period. You can manage or cancel subscriptions in your Apple Account subscription settings.

Deleting the App or stopping use of the App does not automatically cancel an Apple-managed subscription. You must cancel through Apple.

Prices, subscription periods, included features, and availability may vary by country or region and may change as permitted by Apple's rules and applicable law.

10. Privacy

Your use of Oarsum is also governed by our Privacy Policy, available at https://oarsum.com/privacy.

The Privacy Policy explains what data may be collected, stored, processed, or shared, including local paddle data, support messages, diagnostics, analytics settings, HealthKit-related behavior, location-related behavior, and subscription-related information.

11. Local Data and Health Data

Oarsum is designed to keep many paddle records local on your device. Local trip data may remain on your device unless you delete it in the App or remove the App/data from your device.

12. User Content and Feedback

You may submit support messages, bug reports, route-related feedback, water-name corrections, or similar content. You represent that you have the right to submit that content and that it does not violate the rights of others.

You grant us a limited right to use submitted content to operate, support, debug, improve, protect, and maintain Oarsum and related services.

13. Acceptable Use

You agree not to misuse Oarsum, interfere with its services, attempt unauthorized access, abuse support or backend systems, submit unlawful or harmful content, violate others' privacy, use the App to harass or endanger others, or use the App in a way that violates applicable law.

14. Third-Party Services

Oarsum may rely on Apple services such as App Store, StoreKit, HealthKit, WeatherKit, MapKit, iCloud, and Apple Watch. These services are provided by Apple and may be subject to Apple's own terms, policies, availability, and limitations.

Oarsum may also use backend services for support, diagnostics, analytics, or other app functionality. These services may change over time.

You must comply with applicable third-party terms when using Oarsum.

15. No Professional Advice

Oarsum does not provide medical, safety, rescue, legal, navigation, weather, coaching, or professional advice. Information shown in the App is for general fitness, logging, and informational purposes only. Consult qualified professionals or official sources where appropriate.

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Oarsum is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, title, quiet enjoyment, and any warranties arising from course of dealing or usage of trade.

We do not warrant that Oarsum will be uninterrupted, secure, error-free, accurate, complete, timely, or available, or that any GPS, map, WeatherKit, HealthKit, Apple Watch, sensor, route, export, subscription, analytics, or safety-related feature will meet your needs or expectations.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Oddsplash LLC, Oarsum, their owners, operators, affiliates, service providers, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, loss of profits, loss of use, personal injury, death, property damage, rescue costs, medical costs, equipment loss, activity interruption, or other losses arising from or related to your use of or inability to use Oarsum.

This limitation applies whether the claim is based on warranty, contract, tort, negligence, strict liability, statute, or any other legal theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our total aggregate liability to you for all claims arising out of or relating to Oarsum or these Terms will not exceed the greater of: (a) the total amount you paid through Apple for Oarsum or Oarsum+ during the twelve months before the event giving rise to the first claim, or (b) USD $15 (or the equivalent amount in your local currency).

Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so parts of this section may not apply to you. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. This includes, to the extent applicable law prohibits their exclusion or limitation, liability for fraud, fraudulent misrepresentation, gross negligence, willful misconduct, or death or personal injury caused by negligence. Nothing in these Terms excludes or limits any rights or remedies under mandatory consumer protection laws. Where liability may lawfully be limited but not excluded, it is limited only to the maximum extent permitted by law.

18. Changes to the App or Terms

We may update, modify, suspend, or discontinue parts of Oarsum at any time, subject to applicable law and Apple's rules. We may update these Terms from time to time. Updated Terms will be posted in the App or on our website. Your continued use of Oarsum after updated Terms become effective means you accept the updated Terms.

19. Termination

We may suspend or terminate your access to Oarsum or related services if you violate these Terms, misuse the App, create risk or legal exposure, or if required by law or platform rules. You may stop using Oarsum at any time.

20. Apple App Store Terms

These Terms are between you and Provider, not Apple. Apple is not responsible for Oarsum or its content. Apple has no obligation to provide maintenance or support services for Oarsum.

If Oarsum fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, for the App as required by Apple's applicable terms. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Oarsum.

Provider, not Apple, is responsible for addressing claims relating to Oarsum or your possession and use of Oarsum, including product liability claims, claims that Oarsum fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar laws.

If a third party claims that Oarsum or your possession and use of Oarsum infringes that third party's intellectual property rights, Provider, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that intellectual property infringement claim, to the extent required by these Terms and applicable law.

You represent that you are not located in a country or region subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.

21. Export Compliance

You may not use, export, re-export, import, sell, or transfer Oarsum except as authorized by United States law, the laws of the jurisdiction where you obtained Oarsum, and any other applicable laws and regulations.

22. Governing Law and Venue

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law principles. If you are a consumer, this choice of law does not deprive you of the protections of any mandatory laws applicable to you in the country, state, province, or territory where you reside.

Except as provided below or required by applicable law, disputes arising under these Terms shall be resolved in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction in those courts. However, if you are a consumer resident outside the United States, the King County venue requirement does not apply, and you or Oarsum may bring proceedings in any court or tribunal having jurisdiction where you reside.

Nothing in this section limits any right you have under applicable law to bring proceedings in another forum.

23. Severability

If any part of these Terms is found unenforceable, that part will be interpreted or limited to the minimum extent necessary, and the remaining parts will remain in effect.

24. Entire Agreement

These Terms, together with the Privacy Policy and any subscription terms shown in the App or App Store, form the entire agreement between you and Provider regarding Oarsum.
